Brazil federal court rejects Spribe motion, keeps injunction in Aviator Studio case

Brazil’s Federal Court has rejected Spribe’s Motion for Clarification and confirmed that a preliminary injunction obtained by Aviator Studio remains in effect. The decision was issued Thursday 3rd September 2026.

According to the filing summary shared by Aviator Studio, the company responded to Spribe’s motion on August 14. In its latest ruling, the court stated that the motion did not change the original decision or the effects of the preliminary injunction.

Judge Arthur Pinheiro Chaves said that, to properly challenge the merits of the earlier decision, the appellant must use the appropriate procedural mechanism. The court clarified that attempts to revisit the substance of the original ruling must be pursued through the correct legal route.

If Spribe continues to challenge the decision, it may seek review before the Federal Court of Appeals by filing an Interlocutory Appeal, according to the release. The broader case remains ongoing.

Aviator Studio said it is “committed to protecting its intellectual property rights and the integrity of its Aviator brand” and will provide further updates as proceedings continue.
